After the deal was reached the Feds came knocking on his door and required him to register. His attorney immediately filed a motion to set aside the guilty plea and requested a trial. Charles Barberio, successfully argued that the man was mislead at no mistake of his own and that it would be a manifest injustice if the man was not granted a trial. The judge agreed. Several months later Charles Barberio tried the case to a St. Louis County Jury; after deliberation all 12 jurors agreed and found the man NOT GUILTY. Exonerated, his name was removed from the list.

The jury was not sure what to believe; they ultimately returned the NOT GUILTY verdict based on the fact that the state's main witness, the victim, simply could not be trusted.
