My client's mother alleged that my client committed acts of violence and made threats of physical harm against her and filed a petition for a DV protection order that required my client to move out of ... the house remain at least 500 feet away from her mother. The order was granted and after it expired, the petitioner filed a petition to renew. I was hired to represent the respondent on the petition to renew and was successful in getting that petition dismissed.
OUTCOME: Third Degree Assault conviction vacated
My client shoplifted a CD from a record store at the mall and was stopped by security guards on his way out. My client pushed past one of the security guards in his way and was convicted of Second Deg ... ree Robbery as well as Third Degree Assault. I handled the appeal and successfully argued that by convicting my client of both robbery and assault based off of the single act of pushing a security guard, the State violated the Double Jeopardy Clause of the Fifth Amendment.
