This is a criminal defense case. My client was issued a summons to appear in Brookline District Court for an Application for Criminal Complaint. It was alleged that she allowed an "unauthorized person ... " (who was also an illegal alien) to use her motor vehicle. I secured proof from both the RMV and other sources to prove that the person was not, in fact, driving without a license.
OUTCOME: Win. The Boston immigration judge did not deport my client and she is happily living here in the United States
This is an immigration and criminal defense case. My client was charged with shoplifting several years ago. She received a CWOF, which meant she was placed on 1-year probation and ultimately the case ... was dismissed after that year. What she didn't know was that - because she was a permanent resident of the U.S. - she was not allowed to leave the country and come back after she took the CWOF. Her lawyer never told her his. When she went to Jamaica with her children, sure enough, she was Denied Admission into the U.S. and immigration proceedings began. I reopened her case in Dedham District Court and filed a Motion to Vacate her Plea on the grounds that she was not properly advised of her immigration rights at the time she entered into the CWOF. Simultaneously, I worked with another attorney to file for Cancellation of Removal from the United States.
OUTCOME: Case Dismissed
This was a criminal defense case where the client retained my services when he was arrested on a drug charge. Due to the fact that possession of less than 1 gram of marijuana is no longer a criminal o ... ffense in Massachusetts, the police officers in the case did not the requisite probable cause to order my client out of his car and conduct a search. I filed a Motion to Suppress the drugs found in his car, and the prosecutor AGREED that the police were wrong. They dropped the charges.
