My client was charged with possessing an illegal firearm, namely a .45 caliber pistol. The Prosecution alleged that the police received an "anonymous" call from a witness who saw my client with a weap ... on in his waistband and gave a detailed description of my client, everything from his skin color, height to the color of his sweatshirt and shoes. According to the police and the subsequent testimony at trial, they came upon the scene and when they saw my client fitting the description of the witness account, my client ran and was tackled allegedly a block or so down the road. The police alleged they recovered the weapon from my clients pocket. If convicted my client was facing a mandatory minimum of 3.5 years incarceration. A one week jury trial took place before the Honorable Judge Kindler in Bronx County, New York.
