Baldwin v. FAA
Jul 15, 2015OUTCOME: Appeal Granted and the first of its kind decision holding that sexual orientation is covered by Title VII.
David Baldwin filed an Equal Employment Opportunity complaint against his employer, the Federal Aviation Administration, for sexual orientation discrimination. The complaint was dismissed for being "un ... timely filed." Baldwin appealed the decision and also argued that his complaint of sexual orientation discrimination was covered by the 1964 Civil Rights Acts (Title VII). The EEOC agreed and issued an order granting Baldwin's appeal; the charge was timely filed and that Title VII includes protections for individuals based upon their sexual orientation.
