This was an action by Kellogg Brown & Root seeking indemnity against Eby Construction Company for defense cost incurred in defending an environmental claim arising from a construction project where Eby ... was the contractor and KBR was the engineer. We successfully defended the claim for Eby and it was affirmed by the 10th Circuit Court of Appeals.
