The Dillsboro Dam was a small hydroelectric facility situated on the Tuckaseegee River in the town of Dillsboro located in Western North Carolina. The Dillsboro Inn is a small lodging facility situated ... on the banks of the Tuckaseegee River. The inn and the dam were adjacent to each other. They even shared a driveway. When Mr. Miller relocated to North Carolina from New Orleans following Hurricane Katrina in 2005, the owner of the dam, Duke Energy, the individuals who own the inn, and various other public and private parties had been involved more more than six years in litigation with each other over Duke's proposed demolition and removal of the dam; a classic David and Goliath situation given the enormous resources of Duke and the modest resources of the owners of the inn and the other parties to the litigation. Although Mr. Miller is principally a transactional lawyer and not a litigator, and even though he was new to the area and had not been involved with any of the litigation concerning the dam, the owners of the inn engaged Mr. Miller to represent their interests in their very public dispute with Duke Energy. Within four months from his engagement by the owners of the inn, the owners of the inn and Duke Energy reached a settlement of their six plus year dispute. The owners of the inn were the only parties to any of the litigation concerning the dam with whom Duke settled, and no party to any of this litigation secured a judgment favorable to them or contrary to the interests of Duke.
