Goodrich, the successful bidder at tax sale, filed motion for relief from judgment, challenging order that denied his petition to issue tax deed to real property. Following a hearing, the Dearborn Circ ... uit Court, James D. Humphrey, J., denied motion. Goodrich appealed. The motions panel of the Court of Appeals granted in part and denied in part property owner's motion for involuntary dismissal. The Court of Appeals, Sharpnack, J., held that: (1) order denying motion for relief from judgment would be treated on appeal as granting extension of time to file motion to correct error but denying motion to correct error; (2) successful bidder substantially complied with notice requirements even though there was discrepancy between date listed on notice of redemption period and date of mailing; and (3) successful bidder sent notice of redemption period to property owner by certified mail and thus substantially complied with statute governing notices. The case was reversed and remanded to the trial court.
