A nursing home filed a petition for review against the guardian requesting the court make certain legal determinations. The Superior Court confirmed the lower court decision in my favor and held that ... a guardian does not have to obtain court permission before expending the income of the IP where they are not paying the nursing home, that the DPW PA-162 is not a mandate to pay income to the nursing home and that the failure of the guardian to turn over accumulated income does not, in and of itself, constitute a violation of Pennsylvania Law.
