I-140 Approval for a previously denied petition.

OUTCOME: Approval

Our office recently obtained an I-140 approval using a labor certificate from a denied I-140 petition and retained the very old priority date. The previous I-140 was filed by a leading immigration atto ... rney and was denied for employers ability to pay. Our office has refiled the I-140 after 3 years by using the same underlying labor successfully. The client was able to retain the same old priority date and filed I-485.
