Smalls v. Jonathan Lewis, M.D., et al

OUTCOME: Jury verdict in favor of the Plaintiff and against both defendants, the doctor (85%) fault and the hospital (15%) fault in the total sum of $46.5 million dollars.

Dr. Lewis was found to have been negligent in his treatment of Kara Smalls as was the Ouachita Valley Medical Center. He failed to diagnose her condition and take the necessary action to protect and p ... revent the development of kernicterus resulting from a bilirubin level that was too high (jandice). The jury apportioned fault as 85% against the doctor and his clinic and 15% against the hospital resulting in a medical malpractice verdict of $46.5 million dollars for the total damages suffered by Kara Smalls and her parents. This is believed to be the largest medical malpractice verdict in the State of Arkansas.

OUTCOME: Dr. Jaraki won and established a new precedent for physicians in Arkansas and protected the rights of patients.

This case changed the law in Arkansas and established that non-compete agreements for physicians are unenforceable because they interfere with the physician patient relationship.
