ReliaStar Corp. vs. KMG America, Inc., et al.

OUTCOME: Court dismissed 10/12 claims and 5/8 defendants

ReliaStar, a subsidiary of ING, sued KMG America, Kanawha Insurance, and six of KMG's officers, including its Chairman/CEO, CFO and other key executives. ReliaStar sought preliminary injunctive relief ... against defendants; the court denied plaintiff's motion for a preliminary injunction. Plaintiff appealed the decision to the Minnesota Court of Appeals, which affirmed the denial of the preliminary injunction. Thereafter, defendants moved for summary judgment. The court granted summary judgment on 10 of plaintiff's 12 claims, and dismissed 5 of the 8 defendants, including both corporate defendants. The case settled shortly thereafter.

OUTCOME: Court granted summary judgment to defendant.

Storage Technology Corporation (STK) sued Cisco Systems in connection with Cisco's acquisition of NuSpeed Systems, Inc. STK sought $450 Million in damages under six different legal theories, including ... corporate raiding, and misappropriation of trade secrets, breach of fiduciary duty. Following extensive discovery, the federal court granted summary judgment to Cisco. This decision was appealed to the 8th Circuit Court of Appeals, which affirmed the summary judgment disposition of the case.

OUTCOME: Case dismissed at end of plaintiff's case in chief

Plaintiff company sought $1.2 Billion in damages from defendants following Cisco's acquisition of a start-up, NuSpeed Systems, Inc. Plaintiff asserted claims for breach of contract, breach of fiduciar ... y duty, usurpation of corporate opportunity, misappropriation of trade secrets, and various other theories. The case was tried to Judge Peterson in May 2006. After the presentation of the plaintiff's case-in-chief, which lasted 8 weeks, we moved for dismissal of the lawsuit. Judge Peterson granted our motion, dismissing the lawsuit in its entirety and later awarding defendants approximately $650,000 in costs. These decisions were appealed by plaintiff and were affirmed by the Minnesota Court of Appeals. Plaintiff then sought discretionary review by the Minnesota Supreme Court, which rejected plaintiff's request.
