OUTCOME: In client's favor at Bankruptcy Court and District Court, Affirmed by Third Circuit

Client sued on a fraudulent transfer in a Chapter 11. The Trustee of the case alleged that the client had received nearly half a million dollars and sought to recover same to benefit the Debtor's credi ... tors. Filed a motion for summary judgment to decide the case in favor of the client. The Bankruptcy Court granted the motion and the Trustee appealed to the District Court. The District Court affirmed (agreed with the client) and the Third Circuit Affirmed (also agreed) in an opinion released April 2, 2015.

OUTCOME: Partial Summary Judgment in Favor of the Trustee (client)

Trustee filed an adversary action in a large and complex bankruptcy case to recover fraudulent transfers of more than $350,000. In an unusual manner, the defendants had engaged in a business transactio ... n for which the Debtor became liable when the transaction went bust. The Trustee sought to recover the funds from the defendants as a fraudulent transfer. The Trustee moved for partial summary judgment in the case and the Court held in favor of the Trustee.

Trustee brought an action against the Debtors to deny their discharge pursuant to Section 727 of the Bankruptcy Code. Argued on behalf of the Trustee that the Debtors' failure to disclose certain asset ... s relating to Disney Vacation Points and the transfer thereof to their son was a violation of the Bankruptcy Code. The Court held in favor of the Trustee as it related to the husband's conduct, but not the wife's.
