OUTCOME: Judgment reversed and case dismissed.

2013 Tex. App. LEXIS 13147 (Tex. App. Dallas Oct. 22, 2013). Because the landowners' takings claim was premised on their assertion that breach of a condition subsequent voided the city's easement, and ... the requirement that the city return topsoil was not a condition subsequent, the trial court erred in denying the city's plea to the jurisdiction.
