My client, a homeowner, was poorly served by the contractor he entrusted to conduct a major renovation of his residential property: halfway through the project, the general contractor refused to comp ... lete the finish the job unless my client delivered $40,000.00 in ransom. After receiving that illegal windfall, the contractor failed to pay $8,000.00 due to his subcontractor. Under Maryland's mechanic's lien statute, the subcontractor sued my client for what the contractor owed. We responded by bringing the general contractor into the picture--we sued him for breach of contract and unjust enrichment. In his closing argument, Amar Weisman talked about things that are sometimes forgotten: good-faith, fair dealing, clean hands, and the need of a court of equity to act as a court of conscience. Beyond obtaining a $19,066.66 judgment against the general contractor's business, we won a judgment against the contractor personally, for $69.066.00.
