N/AOUTCOME: Conviction Overturned on Appeal
The Defendant/Appellant was charged with a sex crime and convicted after a jury trial. At sentencing, the judge ordered the Defendant to register as a sex offender pursuant to CA Penal Code section 290 ... . After sentencing, the Defendant retained me to represent him on appeal. After reviewing the record, I found that the judge failed to instruct the jury properly, and, significantly, the prosecution conceded this point. The appellate court reversed my client's conviction and ordered his case sent back to the trial court. Please note that, given the nature of the offense charged, and my client's desire for privacy and confidentiality, I am not including my client's name.
