Porterfield v. Mascari II, Inc.
N/AOUTCOME: Victory
In Porterfield v. MascariII, Inc., the Court of Appeals of Maryland considered whether terminating an at-will employee who wanted to consult with an attorney regarding an employment dispute violates p ... ublic policy, thereby giving the employee grounds upon which to state a claim for wrongful discharge. The court held that a general right to counsel is not a clear mandate of public policy sufficient to support a wrongful discharge claim. Thus, finding no exception to the at-will employment rule, the court concluded that the employee had failed to state a claim for wrongful discharge.
