OUTCOME: On bypass of the Court of Appeals, the Wisconsin Supreme Court affirmed the trial court's decision to uphold the annexation

I was an annexation law advisor and co-counsel for the Town of Wilson in this case. While a conditional use permit was pending in the Town of Wilson for a new golf course development by the Kohler Comp ... any, the company annexed its property into the City of Sheboygan using a string of other properties to meet the statutory requirement that the land be contiguous to the City of Sheboygan, even though without the string the Kohler Company's property was not contiguous. The Town of Wilson sued to overturn the annexation and return the properties to the Town of Wilson's jurisdiction. Note: the dissenting opinion repeatedly cited and quoted from a law review article that I published in 2007.

OUTCOME: The City followed the applicable municipal stormwater permit, and thus no Clean Water Act violation; summary judgment granted to the City.

I represented the City of Duvall. A property rights group sued the City of Duvall, claiming the City violated the Clean Water Act, which impacted the property of one the group's members. The federal di ... strict court ruled that the City was following the applicable municipal stormwater permit, and there was no Clean Water Act violation. The decision was upheld on appeal to the U.S. 9th Circuit.
