Matthew was identified by a citizen witness as the driver of a vehicle owned by him. He claimed that the true driver, his girlfriend, had fled the scene. He was highly intoxicated and arrested. Through ... thorough cross examination and closing argument, we convinced the jury that Matthew was not in fact the driver of the vehicle and he was acquitted of a repeat offense drunk driving charge. He was convicted of a violation of the Implied Consent law. A civil rather than criminal charge.
