I represented the Town of Cottage Grove in developing one of the first Transfer of Development Rights (TDR) programs in the State. Olson challenged the Town's TDR Ordinance and Program in 2004, and th ... e Town defended its right to establish and maintain a TDR Program. After a trip to the Supreme Court on procedural grounds, the case was sent back to Circuit Court. The Circuit Court found in favor of the Town of Cottage Grove and upheld the TDR Ordinance and Program. Olson initially appealed, but later decided to voluntarily withdraw his appeal. The Court of Appeals dismissed Olson's claims on July 13, 2011.
