Broadway on June 6, 2012, when the defendant, driving a Ford Excursion without his glasses, drifted into and on top of the bicycle lane immediately in front of ... plaintiff. Not having time to stop plaintiff swerved to the left to go around the SUV but at that moment the SUV driver stopped and the plaintiff struck the SUV's rear and broke the rear window with his helmented head, severely lacerating his face and hand and breaking several teeth and his jaw. Farmers Insurance denied the claim on liability and it remained denied through trial. The jury returned a verdict for plaintiff, finding 100% negligence on the defendant and 0% on the plaintiff.

She and her husband with our assistance prosecuted the driver in traffic court with the Citizen Violation Prosecution, securing a conviction for violation of ORS 811.028. After a lengthy convalescence Yifang was determined to return to tango and strenuous walking in spite of her injuries. She settled her case against the driver after we filed a lawsuit on her behalf in Multnomah County Circuit Court. She allowed the Portland Tribune to interview her about pedestrian hazards and her husband testified in the Oregon Legislature on several legislative safety initiatives to benefit pedestrians.
