Client Receives US Green Card After Deportation Is Overturned

Gehi & Associates recently learned that one of its clients was granted lawful permanent resident status in the U.S. after a long, complicated trajectory. She had entered the US from Guyana in 2002 and ...was placed in removal proceedings on the basis that she had lied to US immigration officials about her true purpose in entering the US. She did not receive notice of a hearing before the Immigration Court, and she was ordered removed without her knowledge, for failure to appear at the hearing. The representation by Gehi & Associates began in 2012, when the firm sent a request for a joint motion to the US Department of Homeland Security (DHS). The request was successful. A joint motion was submitted to the Immigration Court so that the client would be able to pursue adjustment of status through her US citizen husband, and the motion was granted by the Immigration Court. While DHS was considering the request for a joint motion to reopen, Gehi & Associates submitted a request for a stay of removal to US Enforcement and Removal Operations. The stay of removal was granted. The client was now free to attend an interview on the I-130 petition that her US citizen husband had filed on her behalf, without any danger of being detained by ERO on the basis of the removal order against her. She attended the interview and the I-130 petition was approved. The Immigration Court granted the motion to reopen, as well as a subsequent motion to terminate the removal proceedings so that her I-485 application for adjustment of status could be filed with USCIS. USCIS requested a Form I-601 waiver application due to the alleged fraud with which DHS had charged her during the removal proceedings. Gehi & Associates submitted the I-601 waiver application, and within about one month it was approved by USCIS. The client received her lawful permanent resident card in the mail several days later.

While the couple attempted to resolve their marital issues and child-raising issues, the immigrant spouse was ordered removed from the United States. The police were called to the scene and a police report was filed.
