Shortly after his visit, he fell and hurt himself requiring residence ... in a skilled care facility. Meanwhile his wife, Mrs. P, was at home and needing additional care. She was ultimately admitted to a different facility. Applications for MassHealth benefits were ultimately prepared and Mrs. P was moved to the same facility with Mr. P.

The adult son, with parents residing in both Massachusetts and a European country, came to discuss the planning of his parents estate. After disclosing that foreign countries may account for assets di ... fferently from Massachusetts and that Massachusetts may include assets from a foreign country, the son continued to represent his parents needs for estate planning documentation. After discussing the same with the parents, my resulting clients, I prepared documents that will protect them when they are in Massachusetts.

OUTCOME: I was able to negotiate the sale of the property and smooth relations to effectuate the distribution of the sale proceeds.

Three out of four siblings living in states outside of Massachusetts wanted to sell the house inherited following the death of their parents. However, the fourth, local sibling/child, was reluctant in ... cooperating. I represented the three siblings in gaining access to the property, cleaning the property out, listing the property and selling the property to a third party investor.
