This lawsuit alleged the following. On October 29, 2008, Ms. Fischer was driving along Loop 337 in Comal County, Texas from Texas Lutheran University to her home in New Braunfels at approximately 10:0 ... 0 p.m. Traveling in the opposite direction along Loop 337, Mr. Jones was driving, with permission, a Ford F-250 Pickup owned by his employer, TNT. Suddenly, and without warning, Mr. Jones crossed the median, entered Ms. Fischer’s lane of traffic and struck her head-on. At the time of the accident, Mr. Jones was legally intoxicated and driving with a suspended or revoked license. Mr. Jones was sending text messages on his cellular telephone at the time of the accident. Mr. Jones was charged with driving while intoxicated. As a result of the accident, Ms. Fischer has suffered serious personal injuries and her vehicle was a complete loss. Ms. Fischer settled this lawsuit for a confidential amount of money. Further, the company agreed to implement certain measures to ensure that this would not happen in the future.
