OUTCOME: Acquitted, Not Guilty Verdict rendered by the Jury for Arson

The firm client was charged by indictment with the offense of Arson of a Motor Vehicle, a second degree felony, punishable by up to twenty (20) years in prison. The Bexar County Fire Marshal's investi ... gation concluded Randy had intentionally started a fire inside his pickup truck via a Molotov Cocktail with the intent of fraudulently collecting the insurance proceeds. Following the conclusion of the trial, the jury deliberated for under twenty minutes, before rendering their verdict of not guilty. The companion misdemeanor offense of False Report was immediately dismissed by the State, following the jury's verdict.

OUTCOME: Aquitted, Not Guilty verdict rendered by the jury for Conspiracy to Possess with Intent to Distribute Cocaine & Acquitted, Not Guilty verdict rendered by the jury for Conspiracy to Possess with Intent to Distribute Marijuana

Description: DEA Case, a reverse buy, where a government paid informant testified as to the alleged 15 kilo cocaine deal claimed to have been brokered by Miller. Miller was on tape negotiating for mari ... juana with an undercover officer who was introduced to Miller by the paid informant, but in the first trial, the government elected to proceed solely with a cocaine conspiracy case against four men. The recent acquittal was a retrial of the 2012 mistrial (hung jury). In the second trial, the government retooled to add a marijuana conspiracy count and dropped the weakest case from the prosecution. Upon the retrial, Miller was exonerated of all charges by the jury, who chose to acquit both co-defendant's of all charges as well.

OUTCOME: Client spared from incarceration for life, instead sentenced to 16 years for murder

As one example of Kristen 's trial work, Gutierrez was arrested and indicted for the offense of murder. A bond was negotiated for the client and he remained free until the time of trial. The plea off ... er was 35 years TDC, which the Gutierrez turned down and Kristen took the case to trial, needing a result better than 35 years imprisonment for a win. At trial, the State asked for a 60 or 65 year sentence, but Kristen obtained a 16 year sentence from the jury, a result she could not have possibly obtained without disputing and fighting the charges.

OUTCOME: Case dismissed following conclusion of hard fought jury trial.

Client works for a local law firm and was participating in the ethical follies at a downtown theatre. Following the wrap party, where she had some wine, the client was on the way home and had some con ... fusion with the downtown streets and was stopped by an officer. At trial, Kristen conducted a probing cross examination of the arresting officer, which uncovered and revealed major deficiencies in his use and understanding of proper techniques in administrating standardized field sobriety tests. Following the State's presentation of evidence, Kristen and her partner forcefully urged the court to grant a directed verdict of acquittal, arguing that no reasonable jury could find the client guilty beyond a reasonable doubt, based upon the evidence presented. Rather than risk the embarrasment of a directed verdict, the State elected to tender a motion to dismiss, effectively ending the case, preventing the jury from even commencing with their deliberations.
