OUTCOME: The Second Circuit affirmed the district court's grant of summary judgment in favor of our client, ABS, dismissing Spain's $1 billion suit against it.
Spain brought suit in New York seeking to recover over $1 billion in damages in connection with the massive oil spill from the M/T PRESTIGE off Spain in 2002.

Motion to stay pending arbitration denied as agreement to arbitrate was not evidenced by an "agreement in writing" as required under the New York Convention.
OUTCOME: The Supreme Court reversed, overruling its own 135 year old precedent, and expanding federal maritime jurisdiction over contracts.
Exxon sought maritime liens in connection with two bunker deliveries. As to one, the lower courts held that Exxon had acted as an agent rather than supplying the bunkers itself and that under a 135 ye ... ar old Supreme Court case holding that general agency contracts are outside admiralty jurisdiction, there could be no lien.
