Emergency Planning to Avoid Dispute
Mar 07, 2008OUTCOME: Chosen child permitted to live in house after parent's death
I was called to the nursing home for a client who had only days, or hours, to live. She wanted the daughter who had taken care of her to be able to live in her house for as long as needed before it wa ... s sold, despite the desire of another daughter to sell the house immediately for the cash. Within 36 hours, we put the house into a trust, which provided for mediation, arbitration and shifting of legal fees. After the mother's death, the trust provisions helped persuade the other daughter not to sue, but to permit the caretaker to stay in the house for as long as needed.
