Morales v. Morales, 464 Mass. 507, 984 N.E.2d 748 (2013)
N/AOUTCOME: Plaintiff's Verdict
The Supreme Judicial Court held that: (1) Modification of support for children of divorced parents is presumptively required whenever there is an inconsistency between the amount of child support that ... is to be paid under the existing support order and the amount that would be paid under the guidelines; (2) Child support guideline providing that any child support order less than three years old may be modified only if there has been either a change in health insurance coverage or a material change in circumstances was inconsistent with statute governing support for children of divorced parents; and (3) Remand was warranted for purpose of requiring trial court to set forth reasons supporting methods used by trial court to determine each party's income.
