OUTCOME: Green Card granted in removal proceedings

Respondent had been detained up by ICE in 2007 and was put into removal proceedings. I won bond, then filed for permanent residence based on a previously filed but dormant I-140. Due to outstanding cri ... minal court matters and unavailability of visa numbers, resolution was postponed a few times. On the final court date, counsel for the Government took issue with Respondent's criminal history and raised questions as to his truthfulness; however, we were able to demonstrate the criminal history should be no bar to grant of permanent residence, and that issues of truthfulness had been overstated by the Government. The Judge agreed, and granted Respondent his permanent residence.
