Don't accept the money for at least the next 3-4 months. The settlement is property of the estate if it is acquired within 180 days of filing.

They can put a judgment on the joint assets. They cannot take the SS or IRA.

No. This service will end up costing you much more. Talk to an attorney. many will lower thier fees or give you time to pay.

Garnishment proceedure probably means they are starting to sue you (unless these are student loans, and then they don't have to).

Yes. He does not need the mothers permission and you do not have to be notified nor can you object.
