The District Court declined to apply United States Sentencing Guideline § 3B1.2, holding the Defendant did not play a minor role in the offense.

Under the law a confession is not voluntary when obtained under circumstances that overbear the defendant’s will at the time that it is given. In the Bautista-Villanueva case, Mr. Bautista-Villanueva ... was interviewed by federal agents and made certain admissions. Attorney Hardy argued that because the federal agents used threats and promises to get his client to incriminate himself, that his client's statements were not freely and voluntarily made and should therefore be suppressed. The Federal District Court agreed and suppressed the statements.
