Harbor pilots are uniquely qualified for their profession. Each licensed harbor pilot needs to be intimately familiar with the particular port in which she/he pilots. The legitimate interest is to prot ... ect the public health, safety, and welfare. Mr. Sweatt was no exception. He needed to apply for and secure state licensure to pilot ships in our ports. His licensure in a neighboring state was not enough. The Federal Boundary Waters Act did not exempt him from becoming licensed. The federal judge agreed.
