My client, Casino Investments, began construction on his own property, which is part of a Hialeah strip mall. The owner of the remainder of the strip mall obtained an injunction premised upon two easem ... ent provisions. I appealed the ruling to the Third DCA, which reversed, finding that the language of the easement provisions was unambiguous, and did not apply to the construction.
OUTCOME: Succesfully reversed.
My client slipped and fell and was injured in the hallway of her own condo building . The trial court granted summary judgment to the defendant on the "open and obvious" nature of the defect. I appeale ... d to the Third DCA and obtained a reversal because the open and obvious nature of the defect does not insulate the owner from liability where the owner has failed to correct the defect.
OUTCOME: Successsfully reversed.
