Injunctions to Protect Minor Children from Imminent Harm
Jul 24, 2014OUTCOME: The court will usually enter an ex-parte emergency order if the petition alleges facts sufficient to show that a minor child will be subjected to imminent threat of harm or removal from the court's jurisdiction.
A parent who becomes visibly intoxicated while caring for their minor children may be deemed to constitute an imminent threat of harm sufficient to justify the court's emergency jurisdiction.
