OUTCOME: Verdict for the Plaintiff with damages mitigated to one claim for $10,000.00 USD
On-Air Radio personality and Disc Jockey sued a Miami Florida based FM Radio Station under a five count complaint alleging he was employed as the Radio Station's official "Program Director" under Fla. ...Minimum Wage Act –Fla. Stat. 448.110 for a two year period, and, that he was also owed past commissions for sales of commercials and "air-time." Plaintiff sued the Station, Station Manager and Station CFO pursuant to the state statute. Plaintiff alleged damages in excess of $32,000.00 USD jointly and severally from all Defendants. Florida Attorney Edward A. Maldonado was brought into the case only weeks before trial and represented all Defendants through trial. Defense argued that the Plaintiff did not meet the FCC regulatory definition of Radio Broadcast Station "Program Director," and that, such duties had in-fact been performed by the Defendant's Station Manager at all times. Defense further argued that Plaintiff was in an independent contractor as to sales of Radio "air-time" over the two year period and that all commissions had been paid. Plaintiff alternatively alleged that he had served as an employee for a limited five month period assisting her in coordinating other DJ and serving as Station's voice over under an additional verbal agreement with the Station Manager as evidenced by e-mails. Pre-Trial Mediation resulted in an impasse. Case was brought to a three day Jury Trial before the Hon. Judge Dresnick in the Miami-Dade 11th Circuit Court. Upon resting of the Plaintiff's case, Defense successfully moved for dismissal of Station Manager and Station CFO as Defendants from the case, and, for the dismiss four of the five counts Plaintiff alleged. Plaintiff’s only surviving count constituted the verbal employment agreement for the five month period, which was presented to the jury. Jury found Plaintiff was an employee of the Defendant FM Radio Station for the five month period alleged, but was not the Station's Program Director. Jury awarded Plaintiff an amount of $10,000.00 USD comprising of a $500.00 USD per week salary for his work as an employee under the Station Manager.
