Trial Court denied paternity rights where an unmarried gay couple had conceived a child through artificial insemination. Ms. Dempsey filed an appeal after the lower court determined that the father wa ... s simply a sperm donor, and therefore had no parental rights. She argued that the sperm donor statute was inapplicable given the best interests of the child, and the fact that the method of conception should not determine fundamental parental rights and, in that case, the establishment of paternity.
