Plaintiffs brought their 15 month old son to All Children's Hospital because of lethargy. He also suffered from difficulty breathing. The Emergency room physician wrote orders to admit the child, but ... the receiving physician and nurses determined the child was unstable and could not be admitted until stabilized. The child remained in the emergency room for several hours and deteriorated over that time. He ultimately went into congestive heart failure and died. He had a condition known as myocarditis, which could have been treated had the emergency room doctor met the satandard of care. Incredibly, boy was not taken to the intensive care unit had not seen by a pediatric intensivist until shortly before his death. The jury found the emergency room physician and her employer liable for negligence and awarded $15 million in damages. The parties reached a confidential settlement after the verdict and before appeal.
