Mr. Pupo was arrested for DUI (with a person under 18), Felony child abuse, Felony Possesion of Controlled Substance Without Prescription. He admitted to injestion of lexipro, xanex, and alcohol prior ... to and during his driving. After vigorous work and negotiation with the State by the defense, the felonies were dismissed. He was prosecuted for DUI and possession of a legend drug, a misdemeanor. Further discovery and negotiations developed a plea of dismissal of the drug offense and the DUI (.087 breath reading), with a "no contest" plea to reckless driving. Payment of a civil infraction fine for possession of an open container of beer found in Mr. Pupo's truck. Plea to probation with conditions only (i.e., no jail time).
