Plaintiff, 62, was a customer in a wholesale warehouse store. She went to look for toilet paper. As she walked down an aisle she saw an entire wall of toilet paper beginning at eye level and reaching t ... o the ceiling. One of the pallets had its shrink wrap opened, and she went toward the merchandise to take a package. As she went to grab the package, the entire pallet's worth of toilet paper (approximately 18 giant packages of 36 rolls each) fell over on her and threw her to the ground. Evidence revealed that Costco knew that shoppers often tore open shrink wrap from pallets that were 5'8" off the ground and on orange shelves. Evidence at trial showed that a floor walk that is performed hourly to check the entire store had been done in 12 minutes the hour prior to the incident. Costco employees testified that it takes 30 minutes to perform properly. Defendant claimed that shopping was only proper from merchandise stacked on the floor and that the fact that merchandise on pallets was shrink wrapped made it obvious that customers should not select merchandise from the shelves. Defendant alleged that Plaintiff was negligent in failing to use common sense, especially because she was 4'9" tall and the pallet began at 5'8". Defendant claimed that they had never had anyone injured by falling merchandise at this store and none in the country for the prior year. Plaintiff sustained a comminuted fracture to her tibial plateau and fibula fracture requiring two surgeries, including 4 months in an Ilizarov fixator. She is left with a small limp and may need a future total knee arthroplasty.
