Epicor vs. Mac Cal Inc.

Epicor is a huge, multinational software company specializing in "Enterprise Resource Planning" or "ERP" software. Epicor contracted with Mac Cal for a cloud-based ERP system. The system never worked ... and Mac Cal was never able to use it. Epicor nevertheless sued Mac Cal for "breach of contract," claiming that Mac Cal had "misrepresented" its business needs and therefore was still responsible for the full contract price, including monthly "cloud access." Mac Cal cross-claimed for fraud and breach of contract. The parties agreed to a binding arbitration with JAMS, the Hon. John Herlihy presiding.
