OUTCOME: Mr. Witko won and remained entitled to pursue his state court counsel for malpractice.

The Eleventh Circuit Court of Appeals reversed the United States District Court and the United States Bankruptcy Court and let Mr. Witko keep his suit for malpractice against his state court counsel.
