We have handled many cases on behalf of borrowers being sued by their banks (and others who bought the loans from their banks) for foreclosure and collection. We are familiar with the Federal laws tha ... t regulate mortgages and mortgage lending (Truth in Lending Act, Real Estate Settlement and Procedures Act, Fair Debt Collection Practices Act, and others). We utilize our knowledge of these laws to devise defense strategies for our clients. The purpose of responding with defenses and counterclaims is to demonstrate to the Lender that there were real issues with the loan, the way the loan was made, the things the Borrower was promised, the way the accounting was handled, etc.. This changes the lawsuit from a one-sided attack by the lender to a two-party encounter, where our clients have an opportunity to be heard, and to participate in negotiations and/or a trial, for the purpose of getting relief.
