Animal Abuse & Battery Charges in Key West, Florida

OUTCOME: Full Acquittal on All Charges

Local Key West resident, represented by Alan A. Fowler, Esq. and Jason Smith, Esq. was arrested Mallory Square for animal cruelty and battery. The case involved a man whose pet parrot had a loud, acti ... ng-out episode, which was construed to be abuse by a passerby, who grabbed the bird without the owners permission. The owner was unable to regain the bird from the man, and, oddly, the owner was arrested for animal cruelty and battery. Mr. Smith and Mr. Fowler successfully convinced a jury that the bird was not being abused by the man and that the man did not attack the passerby. The man was acquitted of all charges.

OUTCOME: Special Exception Granted - Key West Donut Shop Permitted to Obtain Beer & Wine License

Alan A. Fowler, Esq. represented Glazed Donuts, a gourmet donut shop in Key West, Florida, in pursuit of a beer and wine license to compliment the flavor profiles of its donuts. Although obtaining a b ... eer and wine license is determined by the State of Florida, Key West Municipal Code prohibits the sale of alcohol within 300 feet of a church, school, or funeral home. Accordingly, Glazed Donuts, which is located within 300 feet of a church, was prohibited from selling beer and wine. Alan and Glazed Donuts sought a "Special Exception" to the city's code, which required the consent of the church, careful engagement of the surrounding neighbors, coordination with the City of Key West Planning Department, a written application, and a public appearance and advocacy before the Key West Planning Board.
