Late one night, David Rushing (my client) went to Cross Roads Apartments to visit a friend. While at the apartment complex, individuals drove through in a vehicle and started randomly shooting at peopl ... e walking around. Mr. Rushing was hit twice and sustained injuries. Our investigation revealed the apartment complex had other shootings and criminal activity on their property; however, there was no security personnel, no surveillance or security cameras and the lighting was very poor to non-existent on the night of the shooting. We maintained and established the apartment was negligent in its security of its property.

Fernando Bass v. Boynton Beach Police Department et al

OUTCOME: Settled for $50,000 for Mr. Bass

Mr. Bass was falsely arrested and charge with several robberies in which he was not involved. The robberies occurred in Boynton Beach, yet at the time of these crimes Mr. Bass was living in Georgia and ... was in fact, in Georgia. Along with a "weak" identification, the detectives assigned to the case failed to properly and adequately investigate the crimes and included misleading and false information in the application for the warrant, which was issued and led to Mr. Bass' arrested. Mr. Bass spent several days in jail until/when it was discovered that he was not involved in the crimes as he asserted, which was proven by documented evidence, such as surveillance tape of him in a Walmart in Georgia, purchasing and gas receipts and affidavits of witnesses establishing he was in Georgia at the time of the crimes. The criminal case was dropped by the State Attorney.

My client, Mr. Thomas was shot multiple times by an unknown assailant while one night visiting the property, an apartment unit, owned by Defendant. It was discovered there had been multiple criminal in ... cidents and complaints about crime on the property which Defendant was aware of or should have been aware of, yet there were no security, there was insufficient lighting, no fencing, and no surveilance cameras on the property to deter crime.
