Ct.1 Robbery with a Deadly Weapon, Ct 2. Aggravated Battery, Ct. 3 Attempted Burglary of a Structure. My client was charged with all the above charges. The victim in the case claims to have been assa ... ulted and robbed by my client and another person while he was leaving his convenience store at night after he closed the store. After interviewing the state's witnesses, there was one state witness that saw 3 people running from the scene of the robbery. Since this state witness lived right next to the convenience store and in the area, she was familiar with those particular guys she saw running away from the store. My client was not one of those people running from the store. In addition, my clients family testified that my client was with them the night of the robbery. Despite all this evidence showing that my client was innocent, and the states own witness telling the prosecutor that she did not see my client running from the store, the state still went forward into a trial. After 3 hours the jury came back with the only just verdict of NOT GUILTY because there was a reasonable doubt that my client was even at the scene let alone actually committed the crime.
