Richard Gerald Greco

Richard G. Greco is an experienced trial lawyer, having tried numerous patent infringement, general commercial, securities and criminal cases before judges and juries. He has argued appeals in federal and state courts. Mr. Greco has concentrated on patent infringement litigation for the past 25 years and has had extensive experience in complex patent litigation. He was a partner in the Kaye Scholer LLP patent litigation practice for fifteen years before commencing his own practice.

He has represented major pharmaceutical, chemical and biotechnology companies in litigations on patents claiming pharmaceutical compounds, recombinant proteins, pharmaceutical formulations, drug delivery systems, immunoassays and devices, nucleic acid testing, recombinant cell research tools, transgenic animals and processes for producing recombinant products. His work includes several challenges to abbreviated new drug applications on the world’s leading drugs. Outside the life sciences area, he has handled cases concerning catalysts, temperature measurement devices, jet engine fan blades, voice recorders with computer control capabilities and computer displays.  He has also consulted on anti-trust matters related to patent activities.

Examples of pharmaceutical and biotech litigations handled by Mr. Greco include Pfizer Inc v Mylan (Norvasc®);Pfizer Inc v Apotex, Inc (Norvasc®); Pfizer Inc v Synthon Labs (Norvasc®); University of Rochester v Pharmacia (a major precedent defining the written description requirement); Pfizer Inc v Siegfried Pharmaceuticals (Procardia®); Bayer AG v Barr Laboratories (Cipro®); Pfizer v Mylan Laboratories(Procardia XL®); Xoma Corp v Centocor Inc (anti-sepsis monoclonal antibody); and Spectral Diagnostics Inc v Biosite Diagnostics, Inc (antibody-based cardiac assay); Abbott Labs v. Biosite Diagnostics, Inc. (monoclonal based drug of abuse assay);  He has conducted several claim construction hearings, including a successful claim construction hearing in Chiron Corporation v F Hoffman-LaRoche Ltd concerning the pioneering hepatitis C virus cloning

 Mr. Greco has consulted with counsel outside the United States to co-ordinate litigations of foreign counterparts of United States patents and has worked with Counsel in the United Kingdom, Australia, Japan, Germany, The Netherlands, Italy, Canada, and Jamaica.

                  Mr. Greco has lectured on patent litigation topics to various professional groups and at in house programs including for Pfizer, Inc., sanofi-Aventis, Bristol Myers-Squibb, and Novartis.  He is a co-author of Pharmaceutical and Biotech Patent Law (PLI 2007).
