Client calls a tow truck to replace his vehicle's battery. After replacing the battery, tow truck driver gets into driver seat of client's car and starts engine. Defendant was not trained in operatin ... g a manual transmission vehicle. He did not know that when you start a manual vehicle without depressing the clutch, it will lurch forward. As a result of the poor training on the part of the tow truck company, the employee struck my client with his own vehicle. Client required surgery but was too ill from other comorbidities to have surgery.
