OUTCOME: Assault Discharged at Preliminary Hearing; Vandalism Charge Dismissed at Trial.

Cori W. was accused with a codefendant of assaulting another person with a baseball bat and vandalism for smashing the windows of that person's car. The victim's head was split open and required sever ... al stitches. A thorough examination of the evidence revealed that the victim and her boyfriend were armed with knives, that they had both been consuming alcohol, which affected the accuracy of their memories. The assault charge was discharged at preliminary hearing; the vandalism charge was dismissed on the day of trial.

Lamonte E. is a postman who was arrested on the job, and accused of breaking and entering the home of a customer with whom he got into an argument, in Alameda County. It was learned that he had an out ... standing warrant for another misdemeanor charge in San Mateo County. Lamonte came to the Hallinan Law Firm, a decision that resulted in both cases being dismissed. The San Mateo Superior Court granted our motion to dismiss the case for violation of Lamonte's constitutional rights to a speedy trial. The Alameda District Attorney dismissed that case on the day of trial when it became clear that we were overwhelmingly prepared to lead the jury to a not-guilty verdict.

OUTCOME: Potential Life Sentence Avoided with a Misdemeanor Plea with no Jail Time

Jose H. and his brother were arrested for attempted murder, later charged with robbery, Jose having 3 prior strikes.. Neil Hallinan successfully forced Jose's preliminary hearing before the prosecutor ... could hold the same hearing for his brother. At preliminary hearing, we were able to demonstrate that the complaining witness could not keep a consistent story, that he was goaded into providing incriminating statements against Jose by the lead investigator, and that the lead investigator had a personal animosity towards Jose. The case resolved after preliminary hearing for a simple misdemeanor and no jail time.

OUTCOME: 19-Year Sentence Avoided at Trial with Misdemeanor Plea, Release From Custody

Jesse D. retained us in April 2018, subsequent to his preliminary hearing at which he had been displeased with his representation. He was charged with attempted robbery with the use of a weapon, assaul ... t with a deadly weapon causing great bodily injury, and having a prior strike conviction, thus facing a state prison sentence of 19 years and four months. The prior attorney established facts at the preliminary hearing which only strengthened the prosecutor’s case against Jesse. Once Jesse hired the Hallinan Law Firm, however, we litigated motions, conducted investigations, and methodically whittled down the case against Jesse such that we were able to negotiate a settlement offer with which our client was extremely happy. Jesse was transported to court this morning, in custody, anticipating that we would begin a difficult jury trial. Instead, he pled No Contest to a misdemeanor and is going home tonight.

Terry G. was charged with murder. His nephew had fought a man down the street from Terry's home; Terry was present. Both his nephew and the other man were shot and killed. Terry was recorded on a j ... ail phone call admitting to shooting the other man. After a 3-day preliminary hearing, the murder was discharged by a judge, and Terry G. was freed from custody.

OUTCOME: Hung Jury, Mistrial Declared, Case later Dismissed

Hugh A. was accused of attacking three employees of a tow company who were impounding a U-Haul trailer Hugh had found. He was charged with Assault with a Deadly Weapon, as well as Battery Causing Seri ... ous Bodily Injury. The victim received stitches and reconstructive surgery on his lower lip, chin, and lower gums after Hugh A. jabbed him in the mouth with the jagged end of a metal broom stick. A careful examination of the evidence revealed that all of the prosecution's witnesses provided inconsistent statements, and could not provide similar narratives of what actually happened. The jury deadlocked 8-4 on both charges, and a mistrial was declared. Mr. Allen's case ultimately dismissed by the District Attorney.

David M. was accused by his mother of assaulting her with a deadly weapon - a knife - and threatening to kill her; his daughter alleged that while cleaning her grandmother's house, she found the knife ... used. He had 6 prior strikes. His own mother and daughter testified against him. If convicted, Mr. Mosley would have gone to prison for the rest of his life. After a 4-week trial, the jury acquitted Mr. Mosley of all charges, including assault with a deadly weapon, criminal threats, and elder abuse.
