In re the Marriage of Nichols v. Clark
Feb 08, 2013OUTCOME: Court ruled in our favor, granted primary custody to the mother and allowed the relocation of the children to her residence in New York.
Pierce County Dissolution with two children. My client was in the military and stationed in Kuwait at the time the case was filed. The court temporarily ordered that the children should reside with t ... he maternal grandmother. The father received supervised visitation on a temporary basis. The GAL and the visitation supervisor were very favorable to the father and recommended that he have primary custody despite his long-standing history with drug and alcohol abuse. At trial, we had to discredit the GAL’s investigation in order to allow the mother to retain primary custody of the children and relocate them to her residence in New York.
