I am an associate attorney in Tully Rinckey PLLC’s Albany office, where I focus my practice on employment law. I work with clients on various labor and employment matters, including EEO/discrimination claims, wage/hour law, accommodations, and compliance requirements.
My diligence and passion for labor and employment law started while working at a summer camp in New Hampshire. It was there that I learned how to balance employee needs with workplace demands. Additionally, I learned the importance of clear communication, customer-minded service, and preparedness. One of my favorite parts about being a labor and employment law attorney is the continuing opportunity to hone and develop my legal skills. I firmly believes that the practice of law requires us to find ways to better ourselves, even if we think we are perfect.
I a transplant to the area, originally hailing from Massachusetts. I quickly became attached to the Albany area while earning my undergraduate degree at UAlbany. My fondness for Albany stems mainly from the volunteer fire department I joined in 2015. I now serves as the department’s Captain/training officer. A graduate of Albany Law School, I took classes related to client counseling and advocacy, conducting legal research, and administrative law matters.

Know your rights.
Benjamin was great through my process. I know it’s not easy flighting back as companies rarely admit fault. I made the right decision putting my trust in Tully. Hopefully these companies see the damages they cause as do better for others going forward.
"Benjamin is an incredible attorney who makes it his mission to make sure clients are not only legally taken care of but also are well informed on their matters. He makes each of his legal cases a matter of great import when he obtains a new client, and Benjamin ensures throughout the entire process that the concerns of the client are addressed. Furthermore, Benjamin pays incredible attention to the details and minutia that applies to the black letter law at issue. I endorse Benjamin Westerman, and I highly recommend anyone searching for an Employment lawyer to retain his services."
"Benjamin is an incredibly knowledgeable, compassionate, and skilled attorney. He works endlessly for his clients to receive favorable outcomes that limits risk exposure and financial expenditures."
